Buyer agrees to the terms and conditions outlined in this Online Contract (“Contract”) with respect to the goods, services and information provided by or through the Site. This Contract constitutes the entire and only agreement between the Company and Buyer, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the goods, services and information provided by or through the Site, and the subject matter of this Contract. Buyer agrees to review this Contract prior to purchasing anything and purchase of a good or service shall be deemed acceptance of this Contract.

2. Setup and Payment
Buyer represents and warrants that (i) the credit card information supplied is true, correct and complete and (ii) charges incurred by the Buyer will be honored by the Buyer’s credit card company and (iii) Buyer shall pay charges incurred by Buyer at the amounts in effect at the time incurred, including all applicable taxes
3. Delivery of parcels / shipping
We will ship your parcel to the delivery address you indicated in the Personal Details form. On our website, more specifically in your shopping basket, the exact shipping cost will be indicated before you finalise your order.
Processing time of your order is 1-4 working days.
Your parcel will be prepared for shipment once your payment is processed and received correctly. Your parcel will be shipped using one of the following options:
DELIVERY TO FINLAND
The shipping time to Finland is 1 to 3 working days: validation of your payment + preparation of your order + reception of your parcel by the courier service.
You can pick up your delivery from post automat (postin automaatti) or post office. You can track your delivery with oma posti – application. Carbon neutral Posti Green – delivery.
For deliveries to Europe we use POSTI PRIORITY or PARCEL CONNECT deliveries depending on your country. For deliveries outside Europe we use POSTI PRIORITY or EMS (to China).
POSTI PRIORITY International Post delivery depending on your country to your door, or to your post office (after the possible custom has been declared). You will get a delivery notification. Delivery time to Nordic Countries 3-5 working days, rest of Europe 3-7 working days and outside Europe 6-14 working days.
PARCEL CONNECT Delivery to Europe. Delivery to your door or to your post office, also on Saturdays. You will get a delivery notification. Delivery time 3-8 days depending on your country.The item will be stored for 14 days after the attempted delivery of notification of arrival. Uncollected parcels will be returned to the sender as Parcel Connect Undelivered items.
EXPRESS MAIL SERVICE (EMS) International express delivery. Package will be delivered to your door after the posible custom fees have been paid. Delivery time 3-8 days depending on your country. Items will be delivered to the recipient’s address. Post office box addresses cannot be used.
Restrictions and special items
Please consider that some countries have restrictions on what goods can be imported. This usually implies to silver products. If we detect that some products cannot be sent to you because of these restrictions, we will contact you personally and try to find a solution. If we for some reason cannot ship the products to you, we will refund your purchase.
Silver jewellery will be send as post insured package, and the delivery cost will be higher. The final price will be shown at the check out after inserting your postal code.
4. Customs fees and taxes
We are located in Finland which is part of EU monetary territory. We only charge you product + shipping cost in EUR and the amount is visible on the checkout page when you will place the order. All other fees like customs fees and so on, we are not liable for, you will have to check by contacting your closest customs administration.
If you are outside the EU, you may be charged for import tax, duty and broker’s fees (calculated in your local currency). Duty and import taxes are unavoidable and the amounts charged are at the sole discretion of the Country being shipped to.
5. Payment Methods
Xwander Shop offers following methods of payment.
Online Bank (Finnish Banks)
The Company uses online banking payment system with all major Finnish Banks. These include payments made with accounts in Nordea, Osuuspankki, Säästöpankki, POP-pankki, Danske Bank, Handelsbanken, S-pankki, Ålandsbanken and LähiTapiola. The Company store uses Paytrail –payment service in card payments. The payments will appear in bank statements as received by —– who transfers the payment directly to the owners of the web store.
Credit card payments
The Company accepts Visa-, Visa Debit-, Visa Electron-, MasterCard- and Debit MasterCard –credit cards in the web store. The web store uses Verified by Visa- and MasterCard SecureCode –identity-verifying services. In credit card payments, the transaction is made between the customer and Paytrail Oy.
Paytrail is a secure payment method for the customer.
You can pay quickly and securely with your PayPal account or your debit/credit card without sharing your financial information with us. PayPal uses the latest in data encryption and anti-fraud technology to help keep your information secure, reducing the risk of online fraud.
6. Refund Policy
Purchases made from the Xwander Shop are distance selling in the context of consumer protection legislation. If the Customer wishes to exercise the right to cancel, a return notification must be made within 14 days of receiving the Products. Buyer can return the product only in its original condition.
Byuer must make the return notification by email to Xwander customer service (firstname.lastname@example.org). The products byer wishes to return must then be sent without undue delay to Xwander, and within 14 days at the latest. In such event, Company shall provide Buyer a choice to get direct refund to Buyers credit card or bank account immediately after Company has received the returned product. The refund will be made to the same payment method as the original payment.

In the event of returning the product from Finland, the Xwander Shop will pay for the return delivery. Please contact our customer service and we will provide you with the “helposti-koodi”, Helposti-code for returning your product.
In all returns from outside Finland, the buyer is responsible of paying for the return delivery to us. If buyer returns an item that was opened or shows signs of wear, Xwander will issue a partial refund minus the original shipping charges and return shipping fees.
The content, organization, gathering, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, redistribution, use or publication by a Buyer of any such content or any part of the Site is prohibited.
8. Editing, Deleting, and Modification
Company reserves the right in its sole discretion to edit or delete any information or content appearing on the Site and to remove any goods and services for sale. Upon notice published over the Service, Company may modify this Contract, or prices, and may discontinue or revise any or all aspects of the Site in its sole discretion and without prior notice. Modification of this Contract will be deemed effective upon publication on the Site with respect to transactions occurring after said date.
9. Use of Information
Company reserves the right, and Buyer authorizes Company, to the use and assignment of all information regarding Buyer’s use of the Site and all information provided by Buyer, subject to applicable law.
10. Governing law
This Contract shall be treated as though it were executed and performed in Estonia and shall be governed by and construed in accordance with the laws of Estonia (without regard to conflict of law principles). Any cause of action of Buyer with respect to the Site must be instituted within 3 months after any purchase or be forever waived and barred. All actions shall be subject to the limitations set forth in Section 8. The language in this Contract shall be interpreted as to its fair meaning and not strictly for or against any party.
All legal proceedings arising out of or in connection with this Contract shall be brought solely in Tallinn, Estonia and Buyer expressly submits to the jurisdiction of said courts and Buyer consents to extra-territorial service of process. Should any part of this Contract be held invalid or unenforceable, that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intentions of the parties and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site or the Company is in conflict or inconsistent with this Contract, this Contract shall take precedence. Failure of Company to enforce any provision of this Contract shall not be deemed a waiver of such provision nor of the right to enforce such provision.
12. Right to Refuse
Company reserves the right in its sole discretion to refuse service at any time. Sale of any goods or services is subject to availability.
THE SERVICE, CONTENT, GOODS AND SERVICES FROM OR THROUGH THE SERVICE ARE PROVIDED “AS-IS,” “AS AVAILABLE,” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) UNLESS A SPECIFIC MANUFACTURER’S WARRANTY HAS BEEN CLEARLY PROVIDED IN THE PRODUCT DESCRIPTION. THE SOLE AND ENTIRE MAXIMUM LIABILITY OF COMPANY, FOR ANY REASON, AND BUYER’S SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE PARTICULAR ITEMS PURCHASED. COMPANY AND ANY OF ITS AFFILIATES, DEALERS OR SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND BUYER. THIS SITE AND GOODS AND SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. SOME STATE STATUTES MAY APPLY REGARDING LIMITATION OF LIABILITY.
